DMCA Takedown Policy

1. Introduction

This policy is intended to serve as a guide for addressing allegations of copyright infringement concerning material published on DisabilityHelp.org in compliance with the Digital Millennium Copyright Act (DMCA).

2. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied and is accessible on DisabilityHelp.org in a way that constitutes copyright infringement, please notify us by providing the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, with a specific URL or other specific identification to allow us to locate the material.
  • Your name, address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.

3. Takedown Procedure

Upon receipt of a valid DMCA notice, DisabilityHelp.org will:

  • Promptly remove or disable access to the material that is alleged to be infringing.
  • Notify the content provider or user that we have removed or disabled access to the material.
  • Repeat infringers will have their user access to DisabilityHelp.org terminated.

4. Counter-Notification

If you believe that the material was removed or disabled by mistake or misidentification, you may send a counter-notification containing the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in which your address is located and that you will accept service of process from the person who provided the original complaint.

Upon receipt of a valid counter-notification, DisabilityHelp.org will:

  • Provide the original complainant with a copy of the counter-notification.
  • Inform the original complainant that we will replace the removed material or cease disabling access to it within ten business days unless our designated agent first receives notice from the original complainant that they have filed a court action against the content provider or user.
